    Visto: La Resolución de la Subsecretaría de Pesca N° 62 de 28 de Enero de 1993, del Ministerio de Economía, Fomento y Reconstrucción; el Informe Técnico de dicha Subsecretaría para la determinación de Areas Apropiadas para el Ejercicio de la Acuicultura remitido por oficio Ord. N° 774 de fecha 17 de Noviembre de 1993; lo dispuesto en el artículo 67 de la Ley N° 18.892, de 1989, Ley General de Pesca y Acuicultura y sus modificaciones, cuyo texto refundido, coordinado y sistematizado fue fijado por D.F.L. N° 430, del Ministerio de Economía, Fomento y Reconstrucción, de 1992; lo señalado por la Dirección General de Fronteras y Límites del Estado, según Oficio Ordinario N° F-42 de fecha de 07 de Enero de 1994; y el Decreto Supremo N° 654, de 1994, del Ministerio del Interior.

    Decreto:

    1.- Fíjanse como Areas Apropiadas para el Ejercicio de la Acuicultura (AAA) en la XII Región de Magallanes y de la Antártica Chilena, los espacios marítimos, playas de mar y terrenos de playa fiscales comprendidos entre las latitudes 48°50'30''Sur y 55°04',07,82''Sur, y circunscritos por las coordenadas geográficas que se indican en las cartas naúticas editadas por el Servicio Hidrográfico y Oceanográfico de la Armada (S.H.O.A.), que a continuación se expresan:

    2.- Se entenderan, asimismo, que estan operando en Areas Apropiadas para el Ejercicio de la Acuicultura, de conformidad en lo establecido en el artículo 5° transitorio de la Ley N° 18.892, General de Pesca y Acuicultura, los titulares de Concesiones Marítimas que a la fecha de su entrada en vigencia, se enDTO 330, DEFENSA
D.O. 03.01.1997contraban debidamente autorizados para desarrollar actividades de Acuicultura y, que hicieron uso de la opción que la referida norma legal establece.

    3.- Del mismo modo, se entenderan operando en Areas Apropiadas para el Ejercicio de la Acuicultura, aquellas solicitudes de concesiones que se encontraban en tramitación a la fecha de publicación de la Ley N° 19.079, contaban con Resolución vigente de la Subsecretaría de Pesca para desarrollar actividades de Acuicultura y con permiso de ocupación anticipada otorgado por la Autoridad Marítima.

    4.- Déjase sin efecto D.S. 215 de 15 de Julio de 1994, sin tramitar.

    Anótese, tómese, razón, comuníquese y regístrese en el Ministerio de Bienes Nacionales y publíquese en el Diario Oficial.- Por orden del Presidente de la República, Edmundo Pérez Yoma, Ministro de Defensa Nacional.
